Judge Extends Tax Ban on Indian Cigarette Sales Chris Caya BUFFALO (2009-01-27) Indian smoke-shops across New York will be able to continue selling tax-free tobacco products. In Buffalo Tuesday, State Supreme Court Justice Rose Sconiers extended an injunction barring the state from forcing wholesalers to collect taxes on cigarettes sold to Native American retailers. The judge says the state Tax Department has not implemented a mechanism for collecting the tax. She indefinitely extended the temporary restraining order she imposed in December. Governor David Paterson signed the law last month. |
